These Terms of Service ("Terms") constitute a legally binding agreement between you and My Plan Keeper, Inc. ("MPKAI", "we", "us"). To use the Services, you must accept all the Terms herein. By utilizing the Services in any manner, you are affirming your agreement to these Terms, which will remain in force throughout your use of the Services. This agreement encompasses this document as well as those outlined in the Privacy Policy and Copyright Dispute Policy.

Changes to Terms: As we continually strive to enhance our Services, there may be occasions where changes to these Terms are necessary. We reserve the right to amend these Terms at any time. Should any changes occur, we will notify you by posting an announcement on the MyPlanKeeper.ai website, through email, or by other means.

Should you find the updated Terms unacceptable, you have the option to decline them; however, this will result in your inability to access the Services. Continuing to use the Services following the implementation of these changes constitutes your acceptance of all modifications.

Other than revisions made by us as outlined, no adjustments or alterations to these Terms will be binding unless they are documented in writing and endorsed by both parties.

Privacy: MPKAI takes user privacy very seriously. For the most current MPKAI Privacy Policy, please click to read policy. The Children's Online Privacy Protection Act ("COPPA") mandates that online service providers obtain parental consent before knowingly collecting personally identifiable information online from children under 13. If we learn we have collected personal information from a child under 13, we will delete that information as quickly as possible. Using MPKAI: You may need to create an account, choosing a password and username ("MPKAI User ID"). You agree to provide accurate, complete, and updated registration information. You affirm that you are of legal age to form a binding contract or have obtained parental or guardian consent to use the Services.

Beta Program Disclaimer: Please note that the current version of MyPlanKeeper.ai is a Beta version. This means it is in a testing phase and not all features are fully functional or available. We welcome your feedback to improve the service but cannot guarantee stability or full functionality of all features at this time. Your participation in the Beta is at your own risk, and we appreciate your understanding and patience.

Copyright Dispute Policy

At My Plan Keeper, Inc or MyPlanKeeper.ai ("MPKAI” “we", "us", "our"), we respect the intellectual property rights of others and expect our users to do the same. It is our policy to respond to any claim that Content posted on our platform infringes copyright or other intellectual property rights ("Infringement") of any person or entity.

Reporting Infringements

If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim via email to info@myplankeeper.com, with the subject line: "Copyright Infringement Notice".

Your notification should include the following:

1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.

3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.

4. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail.

5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

 

Counter-Notice

If you believe that your Content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner’s agent, or pursuant to the law, to post and use the material in your Content, you may send a counter-notice containing the following information to info@myplankeeper.com:

1. Your physical or electronic signature;

2. Identification of the Content that has been removed or to which access has been disabled and the location at which the Content appeared before it was removed or disabled;

3. A statement that you have a good faith belief that the Content was removed or disabled as a result of mistake or a misidentification of the Content; and

4. Your name, address, telephone number, and email address, a statement that you consent to the jurisdiction of the federal court located within Florida, and a statement that you will accept service of process from the person who provided notification of the alleged infringement.

If a counter-notice is received by My Plan Keeper, Inc, we may send a copy of the counter-notice to the original complaining party informing them that we may replace the removed Content or cease disabling it in 10 business days.

MPKAI may occasionally introduce services that utilize or are enhanced by artificial intelligence technology (such as the MPKAI AI Assistant Grace™), herein referred to as "AI Services."

AI Services produce outputs through the application of artificial intelligence technologies. As the fields of artificial intelligence and machine learning continue to advance, it's important to recognize their inherent uncertainties. Consequently, the information provided by AI Services might not always be precise or accurate.

It's important to note that the information derived from AI Services should not be seen as a substitute for professional advice in areas such as finance or other specialized fields. It is crucial for you to consult with a qualified professional to validate any information obtained from AI Services before making decisions based on that information.

By using AI Services, you acknowledge the risk of relying on potentially inaccurate information without first seeking validation from a competent individual, which could result in various types of harm, including legal, financial, or physical.

You agree to use the insights gained from the Assistant solely for personal reasons and not to disclose any of the information publicly. Additionally, you commit not to input misleading or irrelevant information deliberately in your interactions with the Assistant to avoid skewing the generated results.
